Who these terms are with

These terms cover website design and build work carried out by Cyber Media Design for a business client. Questions: patrick@cybermediadesign.ie.

What we provide

Website design and build, in three shapes: a single-page site, a multi-page site, and an ongoing monthly service that keeps a site updated. What is included in each is set out on our pricing section, and is confirmed in writing before work starts.

Prices and VAT

Prices shown on this website are starting prices and exclude VAT. The price for your project is the one we confirm to you in writing before work begins. Hosting and domain registration, where we arrange them for you, are billed at cost.

Payment

Half of the agreed price is payable before work starts, and the balance is payable when the site is ready to go live. Monthly services are billed monthly in advance.

Timelines

Most sites go live within seven to ten working days. That depends on how quickly we receive your content and your feedback on drafts, and a project that stalls waiting on either will take longer.

Revisions

Each package includes the number of revision rounds stated for it. Further changes beyond those rounds are quoted separately before we do them.

Your content

You provide the text, images and business details for your site, or approve what we draft for you. You confirm that you have the right to use anything you send us, in particular photographs. We are not responsible for material you supply.

Ownership

When the final payment is made, the finished site and its design are yours. We keep the right to reuse the underlying templates and code that we bring to every project. We will not present your business as an example of our work anywhere without asking you first.

Hosting and domains

If we set up hosting or a domain for you, the account is yours, and you can move it elsewhere whenever you want. We do not hold a site hostage.

Ongoing care

Ongoing care covers keeping your site online, updated and secure, and fixing it if something stops working. It does not include new pages or new features; those are quoted separately before we do them.

Each package includes a period of ongoing care from the day your site goes live, and the length of that period is stated with the package you buy. Hosting and domain registration are not included in it; where we arrange them for you they are billed separately, at cost.

After the included period ends, ongoing care is €199 a year, paid once a year and running for twelve months. It does not renew automatically: we will ask you before another year starts, and it stops if you would rather it did. If we stop providing the service part way through a year you have paid for, we refund the months you have not received.

Cancellation

If you cancel before the site goes live, the initial payment covers the work already done and is not refundable. If we cannot complete the work, we refund what you have paid for the part we have not delivered.

Liability

We do our best to build a site that works well, but we do not promise any particular commercial result from it. If something goes wrong and we are at fault, what we owe is limited to the fees you have paid us for that project. We are not liable for indirect losses such as lost profit.

Governing law

These terms are governed by the law of Ireland and the Irish courts have jurisdiction.
